By using the services of Frey Internet Services, you agree to the following terms and conditions.
1. Scope
These Terms of Service govern the contractual relationship between Frey Internet Services (hereinafter referred to as “we”, “us”) and our customers (hereinafter referred to as “you”) for all offered services, particularly in the areas of web hosting, domain registration, and additional products.
2. Services
We provide services in the fields of web hosting, domain registration, and related services in collaboration with carefully selected partners. Our services are based on modern infrastructure and delivered with great care. Nevertheless, we – as well as our partners and suppliers – do not guarantee uninterrupted availability or specific functionalities. All services are provided “as is”, without explicit or implied warranties regarding suitability, fitness for a particular purpose, or marketability.
3. Commencement and Duration of Contract
The contract begins with the provision of access credentials following your written or electronic order. Unless otherwise specified, the duration for hosting services, domains, and additional products is one year.
4. Termination and Renewal
• Domains: Minimum duration of one year; early termination is not possible. Automatic renewal for an additional year unless cancelled in due time.
• Web Hosting: Can be cancelled at the end of the following month. Automatic renewal for another year unless terminated in advance.
• Add-on Products (e.g., SSL Certificates): Automatically renewed for one year unless cancelled within the specified period.
• Virtual Private Servers (VPS): Must be cancelled at least three months before the end of the term. Automatic renewal for another year unless cancelled.
• Dedicated Servers: Must be cancelled at least six months before the end of the term. Automatic renewal for another year unless cancelled.
Cancellations can be submitted via email from the registered email address or in writing by post.
5. Payment Terms
Our services are invoiced either in advance—such as for hosting packages and domain registrations—or by agreement after project completion (e.g., web development or custom solutions). In the event of delayed payment, we reserve the right to suspend access and apply default interest of 6% as well as collection fees.
6. Customer Responsibilities
The customer is entitled to make their products, services, and content publicly accessible on the servers of Frey Internet Services. The customer bears full responsibility for all content and its legal compliance. Furthermore, the customer agrees to use only such software that does not compromise the security or stability of the servers and to take appropriate measures to protect against known security vulnerabilities.
Frey Internet Services reserves the right to deactivate hosting accounts at any time if their use endangers the stability or security of the systems. In the event of serious violations, the contract may be terminated without prior notice. This particularly applies to the following content and activities:
- Incitement to violence or depictions of violence
- Pornographic or sexually explicit content
- Extremist or radical political statements
- Racist or religiously discriminatory content
- Illegal online gambling
- Distribution of malware or spam
- Sending of mass emails without consent (spam)
- Content that infringes copyrights or other intellectual property rights
- Distribution of copyrighted software or digital works without authorization
Customers are responsible for backing up their own data. Backups created by Frey Internet Services serve solely to restore system environments in the event of failure and reflect the state of data at a specific point in time. The customer is solely liable for any third-party claims or damages arising from the access to or use of their content.
7. Disclaimer of Liability
We shall not be liable for indirect damages, loss of profits, or data loss. Liability is limited to intentional or grossly negligent conduct and capped at the equivalent of the annual fee for the hosting service.
8. Data Protection
Your personal data will be handled in accordance with our Privacy Policy and will not be disclosed to third parties unless necessary for contract fulfillment.
9. Changes to the Terms
We reserve the right to modify these Terms at any time. The most current version will be published on our website. Continued use of our services after changes take effect signifies your acceptance of the updated terms.
10. Jurisdiction and Applicable Law
Swiss law applies. The place of jurisdiction is the registered office of Frey Internet Services.
